Terms and Conditions

1. Seller and scope

These Terms and Conditions apply to orders placed through the online shop at fotzsick.ch. The seller is Fotzsick, a sole proprietorship owned by Andreas Suter, Höfli 51, 8555 Müllheim, Switzerland, email: info@fotzsick.ch.

The shop is intended for adult private customers with a delivery address in Switzerland. Delivery abroad, including to Liechtenstein, is not available.

2. Products

Fotzsick sells latex clothing, accessories, jewellery, limited small-batch series and unique pieces; individual products are handcrafted. Images are for illustrative purposes. Minor variations in colour, texture or handcrafted finish may occur, particularly in handcrafted products, and do not constitute a defect unless they impair the agreed characteristics or fitness for use.

Products marked as made-to-order or custom-made are produced only after the order is received or in accordance with the agreed customer specifications. Limited products and unique pieces will not be reproduced.

3. Orders and formation of the contract

The presentation of products in the online shop is an invitation to place an order and does not constitute a binding offer.

By submitting an order, the customer makes a binding offer to purchase the products in the cart. The contract is formed when Fotzsick confirms the order by email. The order confirmation is sent to the email address entered at checkout after successful payment authorisation.

If a limited product is exceptionally unavailable due to a simultaneous sale or a demonstrable inventory error, Fotzsick will inform the customer without delay. Any payment already made will be refunded using the original payment method.

4. Prices and shipping costs

All prices are stated in Swiss francs. Fotzsick is not registered for Swiss value added tax and therefore does not charge or separately state Swiss VAT.

Shipping costs of CHF 7.50 are charged in addition to the product price. Standard shipping is free for an order value of CHF 300.00 or more after discounts. The total displayed at checkout before the order is submitted is authoritative.

5. Payment

Payment methods available at checkout may include TWINT, Visa, Mastercard, American Express, Shop Pay, Apple Pay and Google Pay. The payment methods shown at checkout at the time of the order are authoritative.

Payment is due when the order is completed. Payments are processed through Shopify and the selected payment providers. Their additional terms may apply.

6. Delivery

Orders are delivered only to addresses in Switzerland, using Swiss Post with shipment tracking.

• Products in stock are generally delivered within 3 to 5 business days.
• Made-to-order products generally require 6 to 8 weeks for production and delivery.

A different delivery time stated on the relevant product page takes precedence over these general estimates. If an order contains both in-stock and made-to-order products, the order will normally be shipped together once all products are ready.

Delivery times are non-binding estimates unless a binding date has been expressly agreed. In the event of a material delay, Fotzsick will inform the customer and, where possible, provide a new estimated delivery date.

The customer is responsible for providing a complete and correct delivery address. Additional costs caused by an incorrect address, refusal of delivery or failure to collect a shipment may be charged to the customer unless Fotzsick is responsible for the cause.

7. No voluntary returns or exchanges

Swiss law does not provide a statutory right to cancel an online purchase. Fotzsick does not offer voluntary returns or exchanges because of a change of mind, an incorrect size selection, dissatisfaction, or trying on the product beyond what is normally required to inspect it.

This applies in particular to close-fitting or hygiene-sensitive latex clothing, unsealed products, made-to-order products, custom-made products, limited products and unique pieces.

An order may be cancelled after the contract has been formed only with Fotzsick's express consent. Products returned without prior agreement do not create a right to a refund.

Statutory rights relating to defects, transport damage and incorrect deliveries remain fully reserved.

8. Inspection and notification of defects

The customer should inspect the delivery after receipt and notify Fotzsick of visible defects, transport damage or incorrect delivery within 7 days of receipt at info@fotzsick.ch. The notification should include the order number, a description of the issue and, where reasonably possible, meaningful photographs.

A product reported as defective should be returned only after consultation with Fotzsick. Fotzsick will bear reasonable return shipping costs for a confirmed defect or incorrect delivery.

9. Statutory warranty

The statutory warranty provisions of the Swiss Code of Obligations apply. Claims arising from defects in the goods generally become time-barred two years after delivery.

In the event of a valid defect, Fotzsick is initially entitled to repair the product or, where possible, replace it. If neither remedy is possible, reasonable or successful, the customer may request an appropriate price reduction or cancellation of the purchase subject to the statutory requirements.

Normal wear and tear, material-specific changes that do not impair fitness for use, and damage caused by improper use, storage or care, oils or unsuitable care products, excessive exposure to ultraviolet light or heat, sharp or pointed objects, or failure to follow the care instructions do not constitute defects.

10. Liability

Fotzsick is liable under applicable law for direct losses caused by a breach of contract. To the extent permitted by law, liability for indirect or consequential loss and loss of profit is excluded.

These exclusions do not apply to intentional conduct or gross negligence, personal injury, or any other liability that cannot legally be excluded.

11. Intellectual property

The content of the online shop, including product designs, photographs, text, graphics and trade marks, is legally protected. Use beyond private purposes is not permitted without Fotzsick's prior written consent.

12. Privacy

Information about the processing of personal data is provided in the Privacy Policy on fotzsick.ch.

13. Governing law and jurisdiction

Swiss law applies, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Mandatory statutory places of jurisdiction, particularly those applicable to consumers, remain reserved.

14. Amendments and authoritative version

The version of these Terms and Conditions published when the contract is formed applies to the relevant order. Fotzsick may amend the terms for future orders.
